How much do you pay back in your Chapter 13 plan?
That is a little complicated and more easily addressed with your attorney. Any priority creditors will need to be paid in full (taxes); any secured debt you keep will need to be paid, sometimes in full, sometimes it gets what is called "crammed down" and not paid in full. Usually, even when paid in full the interest rate can be lowered. All of the remaining debt (medical, credit cards, payday loans, repossessions, etc.) are in the unsecured pool and what you pay back ranges anywhere from 0% to 100%, but at 0% interest. The amount you pay back to the unsecured creditors depends on what amount the means test says you must pay. In any event, even if all is paid back it will be at 0% instead of the outrageous 24% or so you are currently paying, and all late charges, over the limit fees, etc. are stopped.
Schedule an appointment with us to discuss what portion you may (or may not!) pay back in your Chapter 13 plan.
When is my plan payment due?
Your first payment is due thirty (30) days after your bankruptcy is filed, and the same date each month thereafter. If you need a certain day for your plan payment to be due, your signing appointment needs to be scheduled accordingly.
